Mandatory submission of sequence tables under the provisions of WIPO standard ST.26 from August 1, 2022


 



Although Taiwan is not a PCT Contracting State, in order to facilitate global data exchange and searches, it will implement the transition to WIPO standard ST.26 effective August 1, 2022, requiring the submission of a sequence table*1 in accordance with World Intellectual Property Organization (WIPO) standard ST.26 for all patent applications containing nucleotide and amino acid sequences.

Taiwan Intellectual Property Office (TIPO) will accept either the current sequence table or the sequence table compliant with WIPO standard ST.26 for applications filed between July 1, 2022 and July 31, 2022.

 

Submission of Old Sequence Tables

If a sequence list in txt format complying with the current sequence list (old sequence list) or a sequence list complying with the ST.25 standard is submitted on or after August 1, 2022, applicants will be notified of a revised deadline for submitting a sequence list in xml format compliant with the WIPO standard ST.26 and may need to submit a sequence list compliant with ST.26 by that deadline. The filing date (base date) will not be affected by this action.

Handling of divisional applications

If a divisional application is filed on or after August 1, and the original application on which the divisional application is based is filed on or before July 31 under the old Sequence List, the divisional application can be filed under the old Sequence List.

 

 *1  On July 1, 2022, the amendments to the PCT Regulations and PCT Administrative Instructions will enter into force. Therefore, from July 1, 2022, all WIPO members will be required to submit a sequence list (sequence list) in xml format in accordance with the World Intellectual Property Organization (WIPO) standard ST.26 for international applications and national applications containing nucleotide and amino acid sequences.
