The Cabinet Approves the Decision on the Enforcement Date of the Act for Partial Revision of the Patent Act and Other Related Act



The Cabinet approves the decision on the enforcement date of the Act for Partial Revision of the Patent Act and Other Related Acts. Amendments to the 2019 Patent Law came into effect on April 1, 2020, however, the enforcement date of some of the provisions has been finally determined.

1. Patent Act
  Effective October 1, 2020
 (1) Visas (See Articles 105-2 – 105-2-10)
Establishment of a visa system for neutral technical experts to conduct on-site inspections. It is a system where inspectors may enter the alleged infringer’s factories, offices or any other places to conduct searches and submit reports to the court to prove the infringement if required.

2. Design Law
  Effective April 1, 2021 
 (1) Multiple applications for multiple designs, as set forth in Article 7, may be filed with a single application.

 (2) Revision of the classification of goods: the classification table of goods is abolished, and the criteria for the eligibility of a single design is established in accordance with the Ordinance of the Ministry of Economy, Trade and Industry (Article 7).

 (3) Procedural relief provisions (Article 60-10(2), Article 5 of the Patent Law shall apply mutatis mutandis under Article 68)
