Japan Patent Office announced their interim handling procedures regarding “product by process” claims ( Asamura NEWS (Volume 16))
With regard to so-called “product by process” claims, the Supreme Court pronounced on June 5, 2015 their decisions on how the claims should be interpreted. Then, on July 6, 2015, Japan Patent Office announced their interim handling procedures in response to the Supreme Court decisions.
