{"id":8016,"date":"2020-12-08T17:08:49","date_gmt":"2020-12-08T08:08:49","guid":{"rendered":"https:\/\/www.asamura.jp\/en\/?p=8016"},"modified":"2023-03-08T09:22:06","modified_gmt":"2023-03-08T00:22:06","slug":"revised-patent-rules-2020-submission-of-statement-of-working-form-27-8-december-2020","status":"publish","type":"post","link":"https:\/\/www.asamura.jp\/en1\/2020\/12\/08\/revised-patent-rules-2020-submission-of-statement-of-working-form-27-8-december-2020\/","title":{"rendered":"Revised Patent Rules in India (2020): Submission of Statement of Working (Form 27)"},"content":{"rendered":"<p>&nbsp;<\/p>\r\n\r\n<p style=\"text-align: right;\"><span style=\"color: #333333;\"><em><span style=\"font-family: times new roman, times, serif; font-size: 14pt;\">Dec 8, 2020<\/span><\/em><\/span><\/p>\r\n<hr style=\"background: #1d6a96; border-width: 0px; border-style: solid; height: 7px;\" \/>\r\n<p style=\"text-align: center;\"><em><span style=\"font-family: times new roman, times; font-size: 28px;\"><strong><br \/>\r\n<span style=\"color: #333333;\">Revised Patent Rules in India (2020): Submission of Statement of Working (Form 27)<\/span><br \/>\r\n<br \/>\r\n<\/strong><\/span><\/em><\/p>\r\n<hr style=\"background: #1d6a96; border-width: 0px; border-style: solid; height: 7px;\" \/>\r\n<p>&nbsp;<\/p>\r\n<p><img loading=\"lazy\" class=\"alignnone  wp-image-9661\" src=\"https:\/\/www.asamura.jp\/image\/sites\/5\/2000\/NATIONFLAG\/india.jpg\" alt=\"\" width=\"146\" height=\"98\" \/><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">The Indian Ministry of Commerce and Industry, Department for Promotion of Industry and Internal Trade (DPIIT) published the Patents Amendment Rules (2020) on October 19, 2020, and one of these rules is as follows:<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">Rule 131: Filing of Annual Statement of Working (Form 27)<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\"><u>The amendment to Rule 131<\/u><\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">(1) Before the amendment:<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">Patentees and licensees of Indian patents are required to submit an annual statement of working of the patented invention, also referred to as \u201cForm 27\u201d or \u201cSoW\u201d for its form number or abbreviation.<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">Since it was required to submit the Statement of Working (SoW) \u00a0for the period from January 1 to December 31 of a calendar year by March 31 of the following year \u00a0for our clients who entrusted us to handle the annuities payment for their Indian patents, we invited them to submit their annual \u00a0SoW from the end of a year to the beginning of the following year.<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">(2) After the amendment<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">\u3000(2-1) <strong>Change \u00a0to fiscal year and Extension of deadline for submission of SoW<\/strong><\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">Under the new rules, the \u00a0year involved has been changed from calendar year (January 1 to December 31) to Indian fiscal year (April 1 to March 31 of the following year), and the deadline \u00a0for submission of SoW is now within six months from the expiry of each fiscal year, i.e. within six months from March 31 of the end of the fiscal year. Therefore, the SoW for the previous year must be submitted by September 30 of the following year. In this regard, we will be sending invitations \u00a0to the clients who have entrusted us to handle the annuities payment for their Indian patents to submit their annual \u00a0SoW \u00a0on or after April 1 after the end of the fiscal year.<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">In addition, it is no longer necessary to submit the annual SoW during the fiscal year in which the patent is registered, and there is no ambiguity as to when the first SoW should be submitted for a newly registered Indian patent. The words &#8220;Registration&#8221;, &#8220;Working&#8221; and &#8220;Submission&#8221; have the following meanings:<\/span><\/p>\r\n<p><span style=\"color: #333333;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px;\"><strong>Registration:<\/strong> Patents that are granted during this period.<br \/>\r\n<\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px;\"><strong>Working:<\/strong> Period of working of patents on the left for which SoW is required.<br \/>\r\n<\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px;\"><strong>Submission: <\/strong>Period for submission of SoW<\/span><\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">Timeline for Statement of Working (click <a href=\"https:\/\/www.asamura.jp\/image\/sites\/5\/2000\/PDF\/fig20201208.pdf\">here<\/a> if the diagram does not open)<\/span><\/p>\r\n<a href=\"https:\/\/www.asamura.jp\/image\/sites\/5\/2000\/PDF\/fig20201208.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"bottom\" data-toolbar-fixed=\"off\">\u30a4\u30f3\u30c9\u5b9f\u65bd\u5831\u544a\u30bf\u30a4\u30e0\u30e9\u30a4\u30f3HP\u7528-\u82f1A4<\/a>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px; color: #333333;\">Please note that if the period of working were from April 1, 2020 to March 31, 2021 of the fiscal year for the patents granted prior to March 31, 2019 in Timeline Schedule for 2021 SoW, the period from January 1, 2020 to March 31 of the same year under the previous calendar year system would be excluded from the period of working. So, this period is added to \u201cTimeline Schedule for 2021 SoW\u201d,<\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\"><br \/>\r\n\u00a0 (2-2) <strong>Simplification of Form 27<\/strong><\/span><\/p>\r\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">The new Form 27 has been simplified and the main changes are as follows:<\/span><\/p>\r\n<ul>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">The patentee only needs to provide an estimate (which does not need to be exact) of the revenue amount or value generated from manufacturing or imports in India.<br \/>\r\n<br \/>\r\n<\/span><\/li>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">If the estimated revenue or value generated from a particular patented invention cannot be determined separately from the related patents, information about multiple related patents may be submitted together for SoW, provided that all of the patents are granted to the same patentee.<br \/>\r\n<br \/>\r\n<\/span><\/li>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">If the patentee wishes to describe the working or non-working of the patent, a 500-word column is provided.<br \/>\r\n<br \/>\r\n<\/span><\/li>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">All patentees and licensees are required to submit a Form 27 for a particular patent (or series of related patents owned by one patentee). Joint owners may submit them together in a single Form 27.<br \/>\r\n<br \/>\r\n<\/span><\/li>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">An authorized agent may sign the Form 27 on behalf of the patentee or licensee.<br \/>\r\n<br \/>\r\n<\/span><\/li>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">It is no longer necessary for the patentee or licensee to make a statement about the patented invention being partially, adequately, or completely consistent with the public interest needs.<br \/>\r\n<br \/>\r\n<\/span><\/li>\r\n\t<li><span style=\"font-family: arial, helvetica, sans-serif; font-size: 16px; color: #333333;\">It is no longer necessary to report the number of patented products imported into or sold in India, only the total revenue or value of the patented invention in India is required.
